Instructions for filing a dwelling application
General Information for making application.
Instead of having to appear in person at specified hours the contractor or owner can mail permit application to the above address. The permit card and a copy of the application will be returned to the applicant by mail. Fees, building plans and any other support documents should accompany the application. If there is a need to clarify something the inspector will call you at the number you specify on the application. Call 920-655-1735 when you need inspections.
SANITARY PERMIT NOT INCLUDED IN THIS BUILDING PERMIT
Lots using private septic systems or holding tanks require a Sanitary Permit issued by your county or the state. IF YOU ARE CONNECTING TO MUNICIPAL SEWER AND WATER YOU WILL NEED A PERMIT THAT IS ISSUED BY THAT DEPARTMENT. Put the permit number on the building permit application in the blank that is provided.
COUNTY LAND USE PERMITS ARE NOT INCLUDED IN THIS BUILDING PERMIT
Oconto County issues land use permits for all townships in the county. Contact: 920-834-6827 or Fax: 920-834-6821 for more information. The county has some agents located at various locations in the county. If in the Townsend area you may want to contact Bill Bartz at 715-276-6640.
In Oconto County the county “Land Use / Zoning” permit needs to be issued for a Local Building permit to be valid.

ADDRESS NUMBER and CULVERT PERMITS
Address numbers and culvert permits are not issued by the building inspector. Contact your local government office to find out the process for getting address and culverts for your project location.

TRACKING of MUD per Comm 21.125 (c)
Sediment tracked by construction equipment from a site onto a public or private paved road or sidewalk shall be minimized by providing a non-tracking access driveway. The Town encourages the practice of immediately installing a non-tracking access driveway when excavation commences to reduce the chance that roads and road shoulder areas would be damaged. But under no circumstances shall the driveway not be installed as approved on the plot plan, prior to framing above the first floor decking. The sediment cleanup provisions of par. (d) in the code are unaffected by the presence or absence of an access driveway. Note: It is not the intent of par. (c) to require a gravel access driveway where natural conditions, such as sandy soils or solidly frozen soil, already provide non-tracking access. REMEMBER: Mud must be removed daily from roads. Gravel lost during street cleaning must be replaced to original condition at the expense of the owner or contractor.
BUILDING MATERIAL WASTES
All building material wastes shall be managed to prevent pollutants and debris from being carried off the site by runoff. Waste is not to be buried or burned on site. Covered containers are recommended for waste materials on site. Cement trucks must not wash up on roads or public right of way.
Step I
A FORMAL EROSION CONTROL SITE PLAN REQUIRED
Provide a SITE PLAN WITH DETAILS ON HOW YOU WILL PROVIDE EROSION CONTROL that meets storm water management as described by Department of Commerce and DNR standards. Plans must show SET BACK DISTANCES, ELEVATIONS, KIND AND PLACEMENT OF EROSION CONTROL MEASURES AND SPECIAL DRAINAGE CONCERNS
EROSION CONTROL STANDARDS per (Comm 21. 125) State Statute
Erosion control measures shall be placed along down-slope areas and along side-slope areas as required to prevent or reduce erosion where erosion during construction will result in a loss of soil to waters of the state, public sewer inlets or off-site. Be especially cautious to keep soils from spilling into any street that has curb. The contractor is responsible for keeping soil from entering the storm sewer catch basins around the construction site.
Although enforcement is primarily from local authority, your county, the DNR or the State, can all cite the job for violations. If there are potential erosion control issues they must be indicated on the SITE PLAN for this construction site. Show any wet lands, or surface water of any kind.
Use arrows to show slopes greater than 12 % toward streams, lakes, ditches or curbs. Remember that the DNR considers any ditch that flows to any protected watershed will need to be protected from soil or water run off from your construction site.
Some building sites have potentially problematic drainage issues. It is the responsibility of the building permit applicant to consider soil and surface drainage conditions when placing the home on the site. This includes how the placement will influence draining onto adjacent property. It is also the applicant’s responsibility to consider methods to effectively control water ingress into the home at basement windows and widows used for egress from basement.
NOTE 1:
If you disturb less than one acre of land for this construction your DNR NOI erosion control permit is issued with the building permit.
NOTE 2: If you disturb soil in excess of one acre you must file a special NOI form with the Wisconsin DNR that MEETS DNR STANDARDS. The process is described on the Wisconsin DNR. Web site.

Attach a copy of that approved plan with your permit application if that applies to you construction site.
Observe Minimum Setbacks
Front: 110 feet from Federal Hwy. 75 feet from a county Hwy. 63 feet from a town road.
Side & rear: 10 feet from property line.
Lake or stream. 75 foot set back unless variance has been granted by county zoning..
Septic tank must be at least 5 feet from dwelling. Drainage field 10 feet from dwelling or 5 feet from a property line.
Well must be 25 feet from a septic tank or 50 feet from a drainage field.
Detached outbuildings: Front is the same as dwelling. Side or rear is 5 feet from property lines on lots under 100 ft. in width or 7.5 feet if lot width is greater than 100 feet.

Step II
PRINT and FILL OUT the application form.

The following provides some general information on how to fill in some specific blanks.
a)A contractor making a permit application must provide a Contractor License number and a Qualifier License number.
b)The owner can do his own work for a dwelling in which they live or will live. Owners should be aware of the following liability issue and their signature on the permit application is an indication they have read this notice.
101.65(lr) of the Wisconsin Statutes requires municipalities that enforce the Uniform Dwelling Code to provide an owner who applies for a building permit with a statement advising the owner that: If the owner hires a contractor to perform work under the building permit and the contractor is not bonded or insured as required under s. 101.654 (2) (a), the following consequences might occur:
(a) The owner may be held liable for any bodily inquiry to or death of others or for any damage to the property of others that arises out of the work performed under the building permit or that is caused by any negligence of the contractor that occurs in connection with the work performed under the building permit.
(b) The owner may not be able to collect from the contractor damages for any loss sustained by the owner because of a violation by the contractor of the one- and two- family dwelling code or an ordinance enacted under sub. (1) (a), because of any bodily injury to or death of others or damage to the property of others that arises out of the work performed under the building permit or because of any bodily injury to or death of others or damage to the property of others that is caused by any negligence by the contractor that occurs in connection with the work performed under the building permit.
c)A new home requires the use of a licensed plumber and HVAC contractor to make the initial installation.
d)If you check MANUFACTURED the supplier of the manufactured home should be able to tell you if the home has a federal HUD approved certification or a State of Wisconsin certification. The home installer is required to be licensed. Provide that license number.
e)Be sure to provide the name of the electric utility that will provide electric and/or gas service to your home.
f) Do not include cost of land, landscaping or other items extraneous to the dwelling in the cost estimate blank.
STEP III
PROVIDE CONSTRUCTION INFORMATION FOR HOME.
One set of building plans drawn to scale showing foundation requirements, room use, dimensions, window sizes, door sizes and general construction information need to be sent with the application. This plan will be retained by the Town as part of the application.
NOTE: Wall bracing must comply with Comm.21.25. If alternative braced wall or continuously braced wall lines using structural panels are being used under Sub(9) this must be detailed on the building plan. (See 2008 code change.).
Step III-b
CONSTRUCTION DATA SHEET.
Complete the data sheet to supplement the detail on the floor plans.
STEP IV
Provide a copy of the REScheck version 4.2.2 . Form available from the federal Department of Energy or a much easier approach is to have your HVAC contractor provide that completed document to you.
Note 1: Only the 4.2.2 version of the energy calculation software, used in design of one- and two-family dwellings will be accepted as it reflects the new requirements of the Wisconsin Uniform Dwelling Code update that was effective April 1, 2009.
Note 2: You do not need to do this calculation for any HUD or Wisconsin certified manufactured homes because the manufacturer has calculated that standard when getting the HUD or Wisconsin Insigna approval.
STEP V
ENCLOSE CHECK FOR PREMIT FEE:
MAKE CHECK PAYABLE TO TOM SMITH INSPECTIONS LLC.
Single Family Dwelling site built.
Homes up to 800 square feet are $ 335 base price.
Over 800 square feet are $335 plus 25 cents per square foot for area over 800 sq. ft.
Manufactured Homes:
The fee for a manufactured home with a Wisconsin Insignia affixed shall be 2/3 of the above site built fee for the square footage of the closed panel areas and full fee for all site built areas.
Informational notes about fees.
Note 1: Most homes are completed with five to eight coordinated inspections. If construction problems cause this inspection number to exceed eight site visits, each additional inspection will cost $30.
Note 2: Square footage for the purpose of this permit fee calculation is based on finished interior area. If a basement has a finished ceiling and walls, add this square footage to your main living area and calculate the fee based on this total.
Note 3: There are no additional fees for unfinished areas in basements, garages, porches or decks..
Note 4: Most of the electric utilities a now require an inspection of the meter base and electrical service panel prior to the installation of company wire or energizing the service. There will be no additional cost if this inspection is done in conjunction with one of the other UDC required permit inspections. When a special trip is requested it will cost an additional $30 for that inspection.
Note 5: Homes where exteriors are not completed within two years will require a renewal fee of 2/3 the original issue fee. If the exterior is finished but health or safety related components are not completed on the interior a 25% renewal fee may be charged.
STEP VI

EROSION CONTROL MEASURES AND SITE PREPARATION CAN START AFTER THE APPLICATION IS PLACED IN THE MAIL AND WHILE THE APPLICATION IS BEING PROCESSED.
Permission for an early foundation work can be obtained by calling inspector.
STEP VII
POST PERMIT.
Your permit will be returned to you by mail.
When you receive the permit post it on a 16 x 24 inch board in clear view near the street.
No inspections beyond the footing inspection will be done if the permit is not correctly posted …. Ref: Comm 20.09(9)(d)
Permits are active for 24 months from date of issue.
